ESTA Adjustment Additional Court Protections in 9th Circuit, USCIS Memo, See FN 13: "In the Ninth Circuit, a VWP overstay whose adjustment of status application is filed within the 90-day period of admission and denied by USCIS has the right to renew that application in removal proceedings.
